Terms & Conditions

1. Agreement & Contract Scope

These Terms and Conditions govern all commercial interactions, product sourcing, export/import contracts, ocean & air freight logistics services provided by POZHIAMUTHAN IMPEX LLP. By issuing a Purchase Order (PO), requesting a Freight Estimate, or entering into an Export Sales Contract, the Buyer agrees to abide by these terms.

2. Product Sourcing & Quality Specifications

POZHIAMUTHAN IMPEX LLP guarantees that all exported agricultural commodities, spices, and industrial goods adhere strictly to agreed-upon quality inspection parameters:

• All agricultural goods are tested and certified by accredited independent laboratories (SGS / Geo-Chem / Bureau Veritas) prior to container loading.
• Product grade, moisture levels, purity percentages, and export packaging specifications are formally confirmed in the Proforma Invoice (PI).
• Claims regarding quality variation must be filed in writing within 7 calendar days of container arrival at the destination port, supported by official port inspection certificates.

3. Shipping Terms, Pricing & Freight Charges

Commercial pricing and shipping responsibilities follow standard International Commercial Terms (Incoterms 2020):

• FOB (Free On Board): Company responsibility ends once cargo passes the vessel's rail at the loading port (e.g. Nhava Sheva / Mundra / Chennai).
• CIF (Cost, Insurance & Freight): Company arranges freight and marine cargo insurance to the named destination port. Marine insurance covers 110% of invoice value under Institute Cargo Clauses (A).
• Freight rate estimates generated via our website calculator are subject to final carrier confirmation at the time of booking.

4. Payment Terms & Payment Guarantee

Unless otherwise mutually agreed in writing, international trade payments must be secured using:

• Telegraphic Transfer (T/T): 30% advance deposit upon Proforma Invoice confirmation, balance 70% against scan copy of original Bill of Lading (B/L).
• Letter of Credit (L/C): 100% Irrevocable Letter of Credit at Sight issued or confirmed by a top-tier international bank.

5. Force Majeure & Limitation of Liability

Neither party shall be held liable for failure or delay in performing trade obligations caused by acts of God, war, port blockades, maritime piracy, severe weather anomalies, government embargoes, or unexpected customs delays beyond reasonable control.

6. Governing Law & Arbitration

All commercial contracts and legal disputes arising under POZHIAMUTHAN IMPEX LLP shall be governed by the laws of India. Any unresolvable disputes shall be settled through binding arbitration under the rules of the International Chamber of Commerce (ICC) in Chennai / Tamil Nadu, India.
